1. These terms and conditions, hereinafter referred to as the "Regulations," specify the rules for using the hairdressing and cosmetic services provided by STUDIO FRYZJERSKIE GRZEGORZ FEDORYSZYN.
2. All services provided by STUDIO FEDORYSZYN are performed in accordance with the provisions of this Regulations.
3. The Regulations are available on the website www.fedoryszyn.pl and in the STUDIO FEDORYSZYN salon.
4. Clients of the STUDIO FEDORYSZYN salon are required to familiarize themselves with the Regulations before using the Services.
5. Utilizing the Services of the STUDIO FEDORYSZYN salon implies acceptance of the Regulations without the need for a signature.
6. Non-compliance by Clients with the requirements of the Regulations results in the exclusion of liability on the part of the STUDIO FEDORYSZYN salon for the provided Services.
7. Minors aged 13-18 may use the Services of the STUDIO FEDORYSZYN salon only with the knowledge and consent of parents or legal guardians, who assume full responsibility for them.
8. The STUDIO FEDORYSZYN salon is open from Monday to Friday from 9:00 AM to 8:00 PM and on Saturdays from 8:00 AM to 4:00 PM. The STUDIO FEDORYSZYN salon is closed on Sundays and public holidays. The STUDIO FEDORYSZYN salon reserves the right to change opening hours in special cases.
9. Whenever the following terms are used in these Regulations, they should be understood as follows:
a) STUDIO FEDORYSZYN – STUDIO FRYZJERSKIE GRZEGORZ FEDORYSZYN based in Wrocław at Walońska 13, loc. U5, 50-413 Wrocław, NIP: 9121635529, REGON: 021747866.
b) Client – the person for whom the Service is to be performed. If the Service was ordered and paid for by a third party, the Client is considered to be the person for whom the Service is to be performed. This does not deprive the ordering person or entity of rights arising from the contractual relationship between them and the STUDIO FEDORYSZYN salon.
c) Service – hairdressing and cosmetic services offered by STUDIO FEDORYSZYN as part of its activity and performed under an agreement between the Client and the STUDIO FEDORYSZYN salon by a person employed by or cooperating with the STUDIO FEDORYSZYN salon.
d) Price List – the current listing of Services offered by the STUDIO FEDORYSZYN salon along with prices, expressed in Polish zlotys and inclusive of VAT.
e) Agreement – the agreement under which the Service or several Services are to be performed for the Client by an employee of the STUDIO FEDORYSZYN salon or a person cooperating with the STUDIO FEDORYSZYN salon.
f) GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons regarding the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
1. An appointment can be made by phone or in person. Clients must arrive at the scheduled time for their reserved appointments. In case of significant delay, it may be necessary to shorten the Service or refuse to perform it.
2. When scheduling an appointment at STUDIO FEDORYSZYN, the Client is required to provide their true first and last name and current phone number. Providing false information will result in the cancellation of the appointment.
3. The STUDIO FEDORYSZYN salon reserves the right to cancel the Service while simultaneously changing the reservation date or offering the possibility to schedule a new date at a later time, of which the Client will be informed in advance. In case of sudden situations that are not the fault of the STUDIO FEDORYSZYN salon, there is a possibility of canceling or changing the appointment as soon as possible after the situation arises. In other cases, the Client will be informed of any changes to the Service appointment at least 24 hours before the scheduled time.
4. The STUDIO FEDORYSZYN salon requires a deposit of 50% of the initial service price when booking first-time visits, but not less than 200 PLN. The deposit can be made in person at the STUDIO FEDORYSZYN salon or via bank transfer to account number 71 1140 2017 0000 4902 1304 9215, and can also be provided during the appointment booking process or through the Tpay banking system via a link sent during appointment scheduling. This deposit reduces the actual value of the Service on the day it is performed.
5. The deposit must be paid no later than 7 days before the scheduled appointment, and in the case of the Tpay system, the active payment link is valid for 6 hours. After this time, the link expires, and the previously reserved appointment will be automatically canceled.
6. If the Client does not show up for the scheduled appointment without prior notice at least 48 hours before the scheduled visit, the paid deposit will be forfeited and is non-refundable. The deposit is non-refundable in the case of changing the appointment date on the day of the scheduled visit.
7. If the Client misses or cancels three consecutive appointments, STUDIO FEDORYSZYN will require a deposit of 50% of the price for the next scheduled service.
8. Providing personal data and phone numbers by Clients during registration is equivalent to giving consent to the processing of personal data by STUDIO FEDORYSZYN, as mentioned in § 6 of the Regulations.
1. Purchasing a Service at STUDIO FEDORYSZYN is equivalent to the Client making a statement, after prior consultation with an employee of the STUDIO FEDORYSZYN salon, that they have no health or medical contraindications to the Services offered by the STUDIO FEDORYSZYN salon.
2. Before commencing the Services, the employee conducts an interview with the Client to determine whether, due to the Client's health status or potential allergies, there are any contraindications to performing the Services.
3. Contraindications for performing hairdressing services include, in particular, hair in very poor condition and, in some cases, extended hair. For cosmetic treatments, contraindications especially include skin that is not in the appropriate condition required for the procedure.
4. Clients are obliged to inform the employee of the STUDIO FEDORYSZYN salon of any ailments or allergies that may contraindicate the provision of Services before the Services are performed.
5. If the Client provides false information or conceals information requested by the STUDIO FEDORYSZYN salon, neither the salon nor its employees or cooperating individuals bear any responsibility for any negative consequences of the Services or their undesirable effects that could have been avoided had the Client not provided false information or not concealed information.
6. The Client is required to follow post-treatment recommendations according to the instructions provided during the procedure by the employee of the STUDIO FEDORYSZYN salon. Only proper care and adherence to the employee's recommendations can guarantee the best results and effects after the Service has been performed.
7. The STUDIO FEDORYSZYN salon is not responsible for the effects, results, and consequences related to the use of products and cosmetics sourced from entities other than STUDIO FEDORYSZYN.
8. In justified cases, especially in case of doubts regarding the safety of carrying out the procedure, the employee of the STUDIO FEDORYSZYN salon has the right to refuse to perform it or to change the reservation date.
9. Before starting work, the employee of the STUDIO FEDORYSZYN salon checks the condition of their workstation and, if necessary, replenishes the supply of disposable materials, protective gear, disinfected tools, and single-use tools.
10. Before each service, the employee washes and disinfects their hands with a disinfectant according to the procedures and techniques for hand disinfection. The employee repeats these actions during the procedure if they interrupt its continuity, as well as after completing the procedure.
11. Employees of the STUDIO FEDORYSZYN salon are properly trained for the position they occupy and hold all required certificates, licenses, and authorizations to work in their respective roles.
1. The prices listed in the price list, including on the website www.fedoryszyn.pl, are for informational purposes only, may change, and do not constitute a commercial offer within the meaning of the provisions of the Act of April 23, 1964 – the Civil Code.
2. The prices listed in the price list are gross prices (including VAT) and are expressed in Polish zlotys.
3. The STUDIO FEDORYSZYN salon is not responsible for the Client's failure to familiarize themselves with the price list.
4. The scope of work and the amount of cosmetics used depend on the individual predispositions and needs of the Client, which is why the Client will be informed of the detailed and final price of the Service before it begins. In the case of some unplanned additional chemical treatments, the final price may only be provided after the Service has been completed.
5. The Client is obliged to pay for the Services performed.
6. Payment for the provided Services is made after the Service is completed, either in cash or by card.
7. Services may be offered at promotional prices. Promotions and discounts bind the STUDIO FEDORYSZYN salon during their validity period.
8. Promotions and discounts cannot be combined.
1. The STUDIO FEDORYSZYN salon makes every effort to ensure that the services offered are performed in accordance with the highest standards and quality.
2. The Client has the right to submit a complaint regarding the use of the Services offered by the STUDIO FEDORYSZYN salon.
3. Grounds for complaints may include, in particular, the execution of a service other than the Service covered by the Agreement, incorrect execution of the Service covered by the Agreement, or the execution of an improper number of Services covered by the Agreement (in the case of service series).
4. Complaints should be submitted in person at the STUDIO FEDORYSZYN salon or by phone at the numbers 883985550.
5. To address the complaint, the Client may be asked to appear at STUDIO FEDORYSZYN for an inspection.
6. The STUDIO FEDORYSZYN salon accepts complaints regarding haircut services within 5 business days after the Service has been completed. For other services, the complaint must be submitted within 10 business days. Each complaint is considered individually depending on the type of Service performed.
7. If the Client concealed or provided false information during the consultation and subsequent Service, or if they did not adhere tothe recommendations of the STUDIO FEDORYSZYN employee, this will be grounds for not considering the complaint.
8. All complaints will be addressed within 14 days from the date the complaint was submitted by the Client. The deadline for addressing the complaint may be extended if there is a need to submit a complaint to the manufacturer.
9. If the complaint is resolved in favor of the Client, there is a possibility of re-performing the complained Service covered by the Agreement or refunding (in whole or in part) the paid amount.
10. The STUDIO FEDORYSZYN salon is not responsible for the Client's dissatisfaction with the final result of the Service, which arises from the Client's subjective feelings, if it was performed professionally, according to the art, and in a manner consistent with generally accepted standards.
1. The administrator of personal data is STUDIO FRYZJERSKIE GRZEGORZ FEDORYSZYN, located at Walońska 13, loc. U5, 50-413 Wrocław, NIP: 9121635529, REGON: 021747866.
2. Personal data of Clients are processed by STUDIO FEDORYSZYN primarily for the purpose of executing the Agreement (Art. 6(1)(b) GDPR) and, if the Client gives consent, for marketing purposes (Art. 6(1)(a) GDPR).
3. At the same time, data are processed by the Administrator for the following purposes and for the following periods:
a) Sending commercial information via electronic communication (email, SMS) and using telecommunication terminal equipment as well as automated calling systems in accordance with Art. 172 of the Act of July 16, 2004, Telecommunications Law, including all information related to offers, current information about products and services offered by STUDIO FEDORYSZYN, or newsletters (for individuals who have consented to this) – based on Art. 6(1)(a) GDPR – no longer than until consent is withdrawn;
b) Providing Services and handling potential complaints, fulfilling tax and accounting obligations required by applicable law (for individuals using the Services) – based on Art. 6(1)(b) GDPR – no longer than until the expiration of claims related to the completed Services;
c) Handling inquiries that are not directly related to the Services or products – which is our legitimate interest based on Art. 6(1)(f) GDPR – no longer than required to fulfill the above purpose or the statute of limitations for claims;
d) Security of the premises where STUDIO FEDORYSZYN is located – which is our legitimate interest based on Art. 6(1)(f) GDPR – no longer than 30 days.
4. A necessary element of the registration procedure is the provision by the Client of their personal data marked as mandatory and expressing their consent to the processing of their personal data. Providing data is voluntary; however, failure to provide data will result in the inability to realize the Service and conclude the Agreement.
5. The personal data of the Client will be processed for the period necessary to achieve the processing purposes.
6. The recipients of the data are providers of email services, IT solutions for collecting data necessary for sending newsletters and commercial information, as well as entities that process personal data on behalf of the Administrator based on a data processing agreement.
7. Personal data are not transferred to a third country or international organization (i.e., outside the European Economic Area).
8. The Client has the right to control the processing of their personal data, in particular, the Client is entitled to:
a) the right of access to the content of the data under Art. 15 GDPR;
b) the right to rectify the data under Art. 16 GDPR;
c) the right to erasure of data under Art. 17 GDPR;
d) the right to restrict processing under Art. 18 GDPR;
e) the right to data portability under Art. 20 GDPR;
f) the right to object to the processing of data under Art. 21 GDPR.
9. In cases where the Client's data is processed based on Art. 6(1)(a) GDPR, i.e., consent to the processing of personal data, the Client has the right to withdraw that consent at any time, without affecting the lawfulness of processing based on the consent before its withdrawal.
10. The Client may exercise the rights described above by sending a declaration electronically or by mail to the address of the data Administrator.
11. Personal data may be processed automatically, including profiling. Automated processing or profiling will not have any legal effects on the Client.
1. There is a complete ban on smoking and the use of tobacco and nicotine products, including electronic cigarettes, on the premises of STUDIO FEDORYSZYN. There is also a complete ban on the consumption of alcoholic beverages and other types of substances and intoxicants.
2. STUDIO FEDORYSZYN is not responsible for items left on its premises.
3. The facility where STUDIO FEDORYSZYN is located is monitored, and recorded data is stored for a period of 30 days.
1. Every Client has the right to access the Regulations and the Price List.
2. The STUDIO FEDORYSZYN salon reserves the right to change the Regulations.
3. Any matters not covered in the Regulations will always be considered with a willingness to reach a compromise and an agreement that is satisfying primarily for the Clients.
4. In matters not regulated by the Regulations, the relevant provisions of the Act of April 23, 1964 – the Civil Code will apply.
5. All disputes arising from the Services provided shall first be resolved amicably.
6. These Regulations come into effect as of May 25, 2018, and apply to Agreements concluded from that date.
